The Purchase Contract

The first step in any real estate transaction is getting the buyer and seller to agree on the price and terms. Real estate transactions require a written contract. Likewise, if the seller gives you a contract to sign, it’s a good idea to let an attorney review it with you so you know what you’re signing. The buyer and seller should each consult with their own lawyer. Inspection and Financing

Once the buyer and seller agree on a price and other terms, there is usually a window of time that the buyer needs to secure financing. Additionally, buyers should schedule a complete home inspection from a certified inspector. Sellers are required to disclose known defects with the property, but often, buyers don’t know to look for hidden problems a qualified inspector might find. If the inspection reveals any defects, your Clermont real estate lawyer can negotiate with the sellers on your behalf to try and resolve the issue before closing. If no resolution can be reached, your attorney can discuss whether you can walk away. This is why having a lawyer close your real estate transaction is so crucial, as a title company can not handle the potential legal issues that may arise.

The Closing

When all terms of the purchase contract have been completed on the buyer’s side, a closing date will generally be scheduled. Prior to the closing, the buyer’s attorney can review the paperwork sent by the title company to check for anything that might get in the way of the seller’s ability to convey clear title. At your closing, you’ll be asked to sign a variety of documents. After Closing

In the event there are any problems after the sale, your attorney can review any legal remedies available to you to resolve them.
